This platform is owned by the Shocals Enterprises Limited Liability Partnership incorporated under the Indian Partnership Act, 1932 with its registered office at D. Bridgewood House of Hiranandani, Egattur, O.M.R, Chennai 603103 and various products of different nature are marketed and sold using electronic medium more particularly through the domain name (www.Shocals.com).

Your use of this platform is governed by the following terms and conditions. If you transact on this website, you shall be subject to the conditions that are applicable to this platform for such transaction.

TERMS OF USE OF OUR WEBSITE:

These terms govern your use of our website (www.Shocals.com) and our (Android and iOS). If you do not agree with the terms of our use and other policies, you will not be able to use our services and you are requested to uninstall our application ( the “APP”).

Shocals enables the transaction on its platform between the partners who are engaged in the business of consumer goods and the Buyers dealing in with those goods and services (platform services). The Buyers can choose and place orders from a variety of consumer goods which are offered for sale by the various partners using this platform.

Shocals reserves the right , at its sole discretion , to change, to modify, to add and to remove any portion in the terms of use and other Shocals policies. It is the customers responsibility to check and accept the policies. If you continue using the site after the modifications, it means that you are accepting and agreeing to the changes.

Goods and services purchased from this Platform are intended for your personal use and you represent that the same are not for resale or you are not acting as an agent for other parties.

Buyer agrees and undertakes that he/she will not use the Platform to purchase cigarettes and other tobacco products.

USER ELIGIBILITY

Use of this website is available to person who can form legally binding contracts under “the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors , un-discharged insolvents, etc. are not eligible to use the Shocals website. If the user is a minor i.e. below the age of 18 , he/she shall not register as User of the Website. As a minor if he/she want to use the platform , such transaction on the platform shall be made by their legal guardian / parents.

USER ACCOUNT AND REGISTRATION OBLIGATIONS

If the Buyer uses the platform, he/she shall be responsible for maintaining the confidentiality of his / her display name and password and He shall be responsible for all activities that occurs under that display name and password.

You agree that if you provide any information that is untrue, in accurate, incomplete, and not current information and if we suspect that the information provided is untrue, inaccurate, incomplete, not current information or not in accordance with the terms and conditions of Shocals , we shall have the right to block access or suspend or terminate your access on the platform.

You agree that Shocals shall not be responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases, including, where You have failed to update Your revised mobile phone number and/or e-mail address on the Website Platform.

ORDER PLACEMENT AND FINANCIAL TERMS

Orders for the product shall be received using the website www.shocals.com and shall be forwarded to the partner by the Firm via email//WhatsApp/e-messages & any other electronic modes/Courier.

This platform allows the Buyer to place orders and by acceptance of such order by the partners, Shocals will subject to the terms and conditions facilitates the delivery of the goods.

Shocals does not own, sell, or resell the products offered by the partners and does not control the partners. Buyer understands that any Order that he/she places shall be bound to the terms and conditions set out in these Terms of Use including, but not limited to, product availability, delivery location serviceability, and acceptance of Orders by partners.

All payments made against the order or services on the platform by the Buyer shall be compulsorily in Indian Rupees. This Platform will not facilitate transactions with respect to any other form of currency.

Buyers agrees that Shocals acts as the agent for the limited purpose of accepting payments from Buyers on behalf of the partners. Upon your payment of amount to us, which are due to the partner, your payment obligation to the partner is completed, and we are responsible for remitting such amounts to the partner. You shall not, under any circumstances whatsoever, make any payment directly to the partner for Order bookings or completion of the Task made using this Platform.

The partner shall be solely responsible for any warranty/guarantee of the goods or services sold to the Buyers and Shocals will not take up the responsibility.

TERMS OF SERVICE

The Buyer agrees and acknowledges that Shocals shall not be responsible for

  1. The products provided by the partners.

  2. If the partners products are not up to the Buyer’s expectation or leading to any loss or damage to the Buyer.

  3. The availability or unavailability of the products listed on the Website.

  4. The partner providing the wrong or defective products.

GENERAL RETURN POLICY

Products are returnable within the applicable return window if the customer received them in a condition that is physically damaged, defective, or different from their description on the product detail page on Shocals.com.

CANCELLATION POLICY

After making an online payment for a particular order/product/subscription, the customer can cancel the delivery for a particular day/order anytime up to the cut-off time (i.e.,___AM/PM of the day preceding to the date of actual delivery of product).

  1. In the event of an item ordered being unavailable, The Shocals will inform you of such unavailability. In such an event the customer will be entitled to a refund in accordance with our refund policy.

  2. The Shocals reserve the sole right to cancel any Order in the following circumstances:

    • in the event of the designated address falls outside the delivery zone offered by us;

    • failure to contact the customer by phone or email at the time of confirming the order.

    • failure to deliver the customer’s order due to lack of information, direction, or authorization from the customer at the time of delivery; or

    • unavailability of all the items ordered by the customer at the time of booking the order; or

    • in case the delivery person is not allowed inside the compound, community or society or any other reason beyond control causing movement of the delivery person including but not limited to law and order situation.

REFUND POLICY

(a) The customer shall be entitled to a refund only if they pre-pay for the order at the time of placing the order on the platform and only in the event of any of the following circumstances:

  1. The order packaging has been tampered or damaged or spilled at the time of delivery and the customer has not accepted the delivery;

  2. partner cancelling the customer’s order due to

    • customer’s delivery location following outside our designated delivery zones;

    • failure to contact the customer by phone or email at the time of confirming the order booking; or

    • failure to contact the customer by phone or email at the time of confirming the order booking;

  3. The partner cancelling the order at the time of confirmation due to unavailability of the items ordered at the time of booking.

(b) The Shocals decision on refunds, its applicability, etc in all cases shall be at the sole discretion of Shocals and shall be final and binding.

(c) Products marked as non-returnable on the product detail page cannot be returned.

(d) Products may be eligible for replacement only if the same seller has the exact same item in stock.

(e) If the replacement request is placed and the seller does not have the exact same product in stock, refund will be provided.

(f) All refunds will be credited to the customer’s Shocals wallet/account. The customer can also trigger a request in their Shocals wallet/account to transfer the money from Shocals back to source. It will take 3-21 working days for the money to show in the customer’s bank account depending on their bank’s policy. Shocals encourage the customer to review the listing before making the purchase decision.

In case the customer ordered a wrong item, they shall not be entitled to any return/refund.

The customer will not be required to pay for:

The customer agrees to give us the necessary proof including but not limited to images of products having issues for us to process your requests.

The customer may return the product to partner at the time of receipt of product. Alternatively, customer may return the product by contacting Shocals Customer care for the same. It is hereby clarified that no returns shall be accepted after the packaging of product is opened or product is consumed either in part or otherwise by the customer.

Refund will be processed in accordance with the outcome of investigation done by Shocals being fully satisfied with the fairness of the transaction.

Shocals shall not be held responsible for such amounts debited in unsuccessful attempts and customers can raise reversal requests with their bank should there be any unreasonable delay in refund.

PRICING AND AVAILABILITY

We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by e-mail if any products you order turn out to be unavailable. All prices are inclusive of VAT/CST, service tax, Goods and Services Tax ("GST"), duties and cesses as applicable - unless stated otherwise.

ALTERATION OR AMENDMENTS TO THE CONDITIONS

Shocals reserve the right to make changes to the policies, and the conditions of sale at any time. partner/Customers will be subject to the policies and conditions of Sale in force at the time the customer orders goods from Shocals, unless any changes to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by the customers). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

GOVERNING LAW AND JURISDICTION

These conditions are governed by and construed in accordance with the laws of India. You agree, as we do, to submit to the exclusive jurisdiction of the courts at Chennai, Tamilnadu, India. You hereby accede to and accept the jurisdiction of such courts. Each party hereby irrevocably waives any objection which such party may now or hereafter have to the laying of improper venue or forum non convenient. Each party agrees that a judgment in any such action or proceeding may be enforced in other jurisdictions by suit on the judgment or in any manner provided by law. Any and all service of process and any other notice in any such suit, action or proceeding with respect to this Agreement shall be effective against a party if given as provided herein.
